Foxconn's iPhone plant paralyzed as workers strike

Thousands of workers went on strike Friday at a Foxconn plant in China that makes Apple Inc's iPhone 5, paralyzing production of the smartphone, rights advocate China Labor Watch reported.

The reported strike comes at a crucial time for the U.S. corporation, weeks after kicking off its largest-ever global rollout of the smartphone. Apple is already struggling with supply constraints, analysts say.
Citing workers, the labor group said 3,000 to 4,000 workers began their strike at Foxconn's Zhengzhou complex in the afternoon, incensed by over-exacting quality controls as well as demands they work through the week-long Golden Week holidays, which began Monday.

The strike could not be immediately confirmed. Apple declined to comment and Foxconn was not immediately available for comment.
Tensions have boiled over repeatedly in factories operated by Foxconn, the Taiwanese contract manufacturing giant that employs more than a million and makes most of the world's iPads and iPhones.
Last month, thousands rioted at its Taiyuan facility in northern China, disrupting production for about 24 hours and underscoring the potential for labor unrest.
In addition to demanding that workers work during the holiday, Foxconn raised overly strict demands on product quality without providing worker training for the corresponding skills, the Watch said in a statement on its website
Additionally, quality control inspectors fell into conflicts with workers and were beat up multiple times by workers. Factory management turned a deaf ear to complaints about these conflicts and took no corrective measures.

Wall Street week ahead: Big-name profit warnings may mean a pullback

NEW YORK: Wall Street may be bracing for a pullback as U.S. earnings season begins next week - if the clouds of profit warnings from bellwethers ranging from FedEx to Hewlett-Packard lead to a downpour of lower profits - or even losses.

Thanks to aggressive stimulus plans from central banks around the world, the Standard & Poor's 500 index gained 5.8 percent over the third quarter. That sharp rally occurred even as companies were struggling. Earnings for that period are forecast to fall 2.4 percent from the year-ago quarter. If that happens, this would be the first earnings decline in three years, according to Thomson Reuters data.

Market strategists and investors say U.S. stock valuations are broadly out of sync with earnings estimates. They forecast a pullback in stocks in the coming weeks as more companies report results and reduce expectations for the fourth quarter and beyond.

Fourth-quarter estimates for S&P 500 companies show a 9.5 percent gain in profit from a year ago, according to Thomson Reuters data. Analysts say that outlook is too high, given what investors are already hearing from the corporate world.

"It's a divergence right now where the valuations as far as equity prices (are concerned) have soared, and are really putting in place a stronger economy and stronger fundamentals," said Alan Lancz, president of Alan B. Lancz & Associates Inc., an investment advisory firm in Toledo, Ohio.

"But earnings will be the telltale sign," Lancz added. "And if the guidance isn't particularly strong, the market might be setting itself up for a little disappointment. I don't see a major correction, but I do see a pullback."

The earnings season will kick off on Tuesday with results from Dow component Alcoa after the bell. Analysts expect Alcoa's third-quarter results to show it broke even, down from a profit of 15 cents per share a year earlier, according to Thomson Reuters I/B/E/S.

JPMorgan Chase & Co and Wells Fargo, the first big financial names to report, are also on tap next week.

BLAME EUROPE


Nearly half of S&P 500 companies guiding lower for third- quarter earnings blamed weakness in Europe, according to a Thomson Reuters survey. Another 11 percent blamed the weak global economy, 8 percent cited strength in the U.S. dollar, and 6 percent cited the slowdown in China, the survey showed.


Weakness in the U.S. economy hasn't helped. The final read on U.S. second-quarter gross domestic product last month showed growth of just 1.3 percent, weaker than an expected 1.7 percent.

On Thursday, software maker Informatica Corp issued a profit warning and said business conditions were worsening in Europe. The software company is considered a bellwether because its products are used alongside those made by larger software companies.

"Parts of Europe aren't just in recession, they're in depression," said Jeff Kleintop, chief market strategist at LPL Financial in Boston. "I think (analysts) underestimated the extent of the global slowdown, and maybe are still underestimating it."

TECH FEELS CHILL FROM CHINA


While estimates have come down sharply in all 10 S&P 500 sectors since the start of the year, technology is one area where the lower expectations are most notable. Slower growth in China is a big factor in that trend.

Earnings growth in the tech sector is expected to be just 2.3 percent for the quarter, compared with a July 1 forecast of 13.1 percent. Apple Inc is a big driver of those gains.

In an unexpected finding, astronomers have discovered two dense black holes inside an ancient cluster of stars in the Milky Way.
Research describes the detection of two black holes that are about 10 to 20 times heavier than Sun in the globular cluster named M22.
Black holes, so dense that even light can't escape them, are what is left when a massive star reaches the end of its life and collapses in on itself.
Dr James Miller-Jones, from the Curtin University node of the International Center for Radio Astronomy Research (ICRAR), said the discovery of two black holes in the same cluster was a complete surprise.
All the theory up to now says that should not happen in a globular cluster that is 12 billion years old.
"The study was originally searching for just one larger black hole within the cluster of hundreds of thousands of stars which, when viewed from the naked eye, resembles a hazy round 'puff' of light," Miller-Jones said in a statement.
"Simulations of how globular clusters evolve show many black holes are created early in a cluster's history.
"The many black holes then sink towards the middle of the cluster where they begin a chaotic dance leading to most being thrown out of the cluster until only one surviving black hole remains.

Nifty flash crash: Rs 10 lakh cr investor money erased

MUMBAI: A flash 900-point crash in the National Stock Exchange's index Nifty this morning eroded an estimated Rs 10 lakhcrore of investor wealth, though for a brief period.


The Nifty showed a sudden fall of nearly 900 points, or over 15 per cent within seconds, triggering the circuit filter (maximum permissible limit of movement in the index), halting the trade at 0950 hrs for 15 minutes.


During the period, the investor wealth slumped by nearly Rs 10 lakh crore.

The Nifty finally closed the day at 5,746.95, down 40.65 points or 0.70 per cent, recovering most of the initial losses. On the other hand, the Sensex ended 119.69 points lower at 18,938.46.

Market regulator Sebi has begun initial probe into the flash-crash.

NSE has claimed there were no technical glitches in its system and the crash was due to 'erroneous' trade orders worth over Rs 650 crore by Emkay GlobalBSE -9.86 %, which has been now disabled by the bourse for trading.

The exchange said the abnormal orders were 'non-algo' in nature and were entered for an erroneous quantity which resulted in executing trades at multiple price points across the entire order book. The exchange has also identified these orders to a specific dealer terminal.

The incident occurred on a day when expectations were high for a significant upward rally on the bourses, following some major reform measures approved by the government last evening, including on
FDI in sectors like insurance and pension.

KOLKATA: Mamata Banerjee's cabinet has given a green signal to the state finance and excise minister Amit Mitra to revamp the state excise department for generating more revenue.

The state cabinet met on Saturday and the chief minister has given her nod to Mitra's proposal for reorganising the excise department.


After the cabinet meeting, Mitra told reporters that the state excise department was reorganised for the last time in 1966.


"In 2011-12, the excise department had earned a revenue worth Rs 2100 crore. There are enough scope for earning more revenue and for the purpose, we have reorganised the entire excise department.


The chief minister has given her clearance to our proposal for revamp of the entire department. There were 21 excise districts in the state which has been increased to 24.


There will be 87 excise ranges against the existing 65. Similarly we have decided to increase the excise circles to 215 from the existing 159. To revamp the entire excise department, we will require Rs 2.70 crore," Mitra said on Saturday.


According to Mitra, revamping of the excise department will fetch an extra earning of Rs 200 to Rs 300 crore every year. He also said that registration and
stamp duty establishments will also be reorganised.

"Such offices were reorganised for the last time in 1993. "Files are piling up in registration offices and we require urgently to clear all these files and for the purpose, we are planning to set up more offices to help the common people and earn more revenue," said Mitra.

Pakistan struggles with smuggled Buddhist relics

ISLAMABAD: Lacking the necessary cash and manpower, Pakistan is struggling to stem the flow of millions of dollars in ancient Buddhist artifacts that looters dig up in the country's northwest and smuggle to collectors around the world. The black market trade in smuggled antiquities is a global problem that some experts estimate is worth billions of dollars per year.

The main targets are poor countries like Pakistan that possess a rich cultural heritage but don't have the resources to protect it.

The illicit excavations rob Pakistan of an important potential source of tourism revenue, as valuable icons are spirited out of the country, and destroy any chance for archaeologists to document the history of the sites.

"We are facing a serious problem because Pakistan is a vast country, and we have very meagre resources," said Fazal Dad Kakar, head of the government's department of archaeology and museums. "We have no manpower to watch the hundreds of Buddhist sites and monasteries in the country, most of which are located in isolated valleys."

Many of the sites are in the Swat Valley, a verdant, mountainous area in the northwest that was once part of Gandhara, an important Buddhist kingdom that stretched across modern-day Pakistan and Afghanistan more than 1,000 years ago.

Police seized a large container filled with nearly 400 artifacts in the southern port city of Karachi in July that were being trucked north to be smuggled out of the country.

About 40% were found to be genuine, including nearly 100 Buddhist sculptures up to 1,800-years-old worth millions of dollars, said Qasim Ali Qasim, director of archaeology and museums in Sindh province.

There were effectively no restrictions on whisking Buddhist relics out of Pakistan's northwest in the first few decades after the country achieved independence from Britain in 1947, said Malik Naveed, a former police chief of Khyber Pakhtunkhwa province, where the Swat Valley is located.

Laws Difficult to Enforce


That changed in 1975 when the government passed a set of laws criminalising the practice. But Kakar, the federal archaeology chief, said the laws are difficult to enforce given a lack of funds, and people who are caught rarely receive punishments severe enough to act as much of a deterrent.

Hazare's remarks came against the backdrop of Kejriwal levelling allegations yesterday that Vadra had bought property worth crores of rupees with an "unsecured interest free loan" of Rs 65 crore given by realty major

He said when they raised allegations against 15 "corrupt" ministers earlier, the government noted that there was no case in them. "Now, two of the ministers are out. The
coal scam is out. Whole country has seen it," he said.

PASADENA, Calif. -- NASA's Curiosity rover is in a position on Mars where scientists and engineers can begin preparing the rover to take its first scoop of soil for analysis.
Curiosity is the centerpiece of the two-year Mars Science Laboratory mission. The rover's ability to put soil samples into analytical instruments is central to assessing whether its present location on Mars, called Gale Crater, ever offered environmental conditions favorable for microbial life. Mineral analysis can reveal past environmental conditions. Chemical analysis can check for ingredients necessary for life.
"We now have reached an important phase that will get the first solid samples into the analytical instruments in about two weeks," said Mission Manager Michael Watkins of NASA's Jet Propulsion Laboratory in Pasadena, Calif. "Curiosity has been so well-behaved that we have made great progress during the first two months of the mission."
The rover's preparatory operations will involve testing its robotic scooping capabilities to collect and process soil samples. Later, it also will use a hammering drill to collect powdered samples from rocks. To begin preparations for a first scoop, the rover used one of its wheels Wednesday to scuff the soil to expose fresh material.
Next, the rover twice will scoop up some soil, shake it thoroughly inside the sample-processing chambers to scrub the internal surfaces, then discard the sample. Curiosity will scoop and shake a third measure of soil and place it in an observation tray for inspection by cameras mounted on the rover's mast. A portion of the third sample will be delivered to the mineral-identifying chemistry and mineralogy (CheMin) instrument inside the rover. From a fourth scoopful, samples will be delivered to both CheMin and to the sample analysis at Mars (SAM) instrument, which identifies chemical ingredients.
"We're going to take a close look at the particle size distribution in the soil here to be sure it's what we want," said Daniel Limonadi of JPL, lead systems engineer for Curiosity's surface sampling and science system. "We are being very careful with this first time using the scoop on Mars."
The rinse-and-discard cycles serve a quality-assurance purpose similar to a common practice in geochemical laboratory analysis on Earth.
"It is standard to run a split of your sample through first and dump it out, to clean out any residue from a previous sample," said JPL's Joel Hurowitz, a sampling system scientist on the Curiosity team. "We want to be sure the first sample we analyze is unambiguously Martian, so we take these steps to remove any residual material from Earth that might be on the walls of our sample handling system."
Rocknest is the name of the area of soil Curiosity will test and analyze. The rover pulled up to the windblown, sandy and dusty location Oct. 2. The Rocknest patch is about 8 feet by 16 feet (2.5 meters by 5 meters). The area provides plenty of area for scooping several times. Diverse rocks nearby provide targets for investigation with the instruments on Curiosity's mast during the weeks the rover is stationed at Rocknest for this first scooping campaign.
Curiosity's motorized, clamshell-shaped scoop is 1.8 inches (4.5 centimeters) wide, 2.8 inches (7 centimeters) long, and can sample to a depth of about 1.4 inches (3.5 centimeters). It is part of the collection and handling Martian rock analysis (CHIMRA) device on a turret of tools at the end of the rover's arm. CHIMRA also includes a series of chambers and labyrinths for sorting, sieving and portioning samples collected by the scoop or by the arm's percussive drill.
Following the work at Rocknest, the rover team plans to drive Curiosity about 100 yards (about 100 meters) eastward into the Glenelg area and select a rock as the first target for use of its drill.
JPL, a division of the California Institute of Technology, manages the Mars Science Laboratory Project and built Curiosity.

    THE SPECIAL MARRIAGE ACT,1954

    This act provides the performance of a marriage in a civil court. according to this act, it is not necessary for a person to belong to a particular caste or religion.
    Any person, belonging to any religion- hindu, muslim, sikh, jain, buddhist, parsi, jews or christians can marry under this act.
    Inter-caste marriages are also allowed under this act.
    This Act is applicable to the entire territory of India (excluding the states of Jammu and Kashmir) and extends to intending spouses who are both Indian nationals living abroad.

    For a marriage to be performed , a notice is to be sent to the marriage registrar by any one of the parties interested to perform the marriage.
    The format of the notice which need to be sent is specified under schedule II of the act.

    Special Marriage Act, 1954 provides for solemnisation of marriages in accordance with the provisions of the Act. SDMs/ADMs/Deputy Commissioners have been authorised as Marriage Officers for this purpose.

In such a case, the ADM shall not solemnize the marriage until he has decided the objection, within 30 days of its receipt. If the ADM refuses to solemnize the marriage, any of the parties may file an appeal within 30 days to the District Court. In case no objection is received, the ADM solemnizes the marriage after 30 days of the notice. Both parties alongwith 3 witnesses are required to be present on the date of solemnization of marriage. It is advisable to submit names of witnesses atleast one day in advance.

    if a person has an objection to intend the marriage he /she can file an objection in the marriage registar's office within 30 days of publication of the notice. an investigation takes place for the objection, and if the objection held is true under and prohibited case then the marriage cannot be solemnized. the parties can hence file an appeal in the district court for the solemnization of the marriage. the decision of the district court will be held as final decision and the registrar will work according to the orders.

    if there is no objection held, the parties will receive a letter from the marriage registrar stating that the parties are now allowed to get married. the parties need to pay some amount of fees as prescribed by the state government under this act.

    1.8.2012 (UNI) India has signed a revised Double Taxation Avoidance Agreement (DTAA) with Indonesia for the avoidance of double taxation and for the prevention of fiscal evasion with respect to taxes on income.

    The revised DTAA gives taxation rights in respect of capital gains on alienation of shares of a company to the source State.

    The agreement further provides for rationalisation of the tax rates on dividend income, royalties and fees for technical services in the source State up to 10 per cent threshold limit.

    The revised DTAA further incorporates provisions for effective exchange of information, including banking information and sharing of information without domestic tax interest.

    It also provides for assistance in collection of taxes between tax authorities and incorporates Limitation of Benefits and anti-abuse provisions to ensure that the benefits of the Agreement are availed of by the genuine residents.

    The revised DTAA will provide tax stability to the residents of India and Indonesia and facilitate mutual economic cooperation as well as stimulate the flow of investment, technology and services between India and Indonesia.

    The revised DTAA was signed on July 27, 2012 in the national capital by India's External Affairs Minister S M Krishna and his Indonesian counterpart R M Marty M Natalegawa. UNI

    Bombay HC grants relief to Amitabh Bachchan in IT case
     
    25.7.2012 (UNI) The Bombay High Court granted relief to megastar Amitabh Bachchan by dismissing an appeal filed by the Income-Tax Commissioner who reopened the actor's assessment proceedings for 2002-03.

    In their order passed recently, Justices M S Sanlecha and S F Vajifdar upheld an order of Income Tax Tribunal which, on March 19 2010, held that the assessment officer was not justified in starting proceedings under section 147 of IT Act against Amitabh.

    The judges further ruled that Commissioner of Income Tax (Appeal) and Income Tax Tribunal had correctly come to a conclusion that there was no tangible material before the assessment officer to reach a reasonable belief that the income liable to tax had escaped assessment.



    On October 13, 2002, Amitabh had filed returns stating his income at Rs 14.99 crore for Assessment Year 2002-03. Thereafter, on March 31, 2002, he filed revised returns declaring his total income for the assessment year 2002-03, wherein he claimed expenses at 30 per cent ad hoc amounting to Rs 6.31 crore and determining his income at Rs 8.11 crore.

    However, before the assessment for the year 2002-03 could be completed, the actor, by a letter dated March 13, 2004, withdrew the revised returns along with his claim of deduction of 30 per cent ad hoc expenses from his total income.

    Being aggrieved, the actor filed an appeal before the Commissioner of Income Tax (Appeals) challenging proceedings under section 147 of the Act and consequent completion of assessment by an order dated December 31, 2007.

    On March 4 2009, the Commissioner of Income Tax (Appeal) set aside the reassessment order dated December 31, 2007, holding that the assessing officer had wrongly assumed jurisdiction under section 147 of the IT Act.

    After that, he moved the High Court which observed that that the Commissioner of Income Tax (Appeal) as well as Income Tax Tribunal have correctly come to conclusion that there was no 'fresh tangible material' before the assessment officer to reach a reasonable belief that income liable to tax had escaped assessment.     Turn Off the Main Water Supply

    "If you're going to have a leaking supply line, it's going to happen while you're away," says Fred Spaulding, president of Quality Home Improvements, Inc., in Kingwood, Texas. And a major leak could be catastrophic if there's nobody around to deal with it. In the Houston area, where he lives, for example, hot-water tanks are placed in attics to avoid taking up floor space in living areas. "If that water tank leaks, you'd better catch it quick," he says. "I've seen cabinets in kitchens destroyed. It only takes a little bit of a leak."

    Closing the valve on the main supply line cuts off water to the house but still allows outside sprinklers to work. If you do spring a leak inside, the line will be under some initial pressure, but it will not continue to spray water. "Instead of thousands, literally thousands, of gallons of water, you might have 50 gallons from the hot-water tank leak," Spaulding says. "There is no downside whatsoever [to turning off the water]. It takes a little bit of time, and it can save thousands of dollars in potential damage."

    Check the Sump Pump

    Another type of water—rainwater—can also be a nightmare. If your sump pump fails while you're gone and a major storm comes around, you could return to a flooded basement.

    So make sure the sump pump is working before you leave town. "Dump a bucket of water in there so you don't get that kind of surprise when you come home," says Tom O'Grady, president of O'Grady Builders in Drexel Hill, Pa. The pump should turn on when the pit fills with water.

    Keep Flowers Alive With a Soaker Hose

    If you'll be gone for several days and don't have an in-ground sprinkler system (or a neighbor kid who can water your garden), use a soaker hose to keep the flowers or veggies watered. You can to set up your hoses on a timer to turn them on and off at preset times.

    Unplug Electronics

    If any of your televisions, computers, stereos, and other electronics are plugged directly into the wall rather than into a surge protector, pull the plugs in case a power surge happens while you're away. If you do have them all run through surge protects, O'Grady says, you can simply flip the switch to power them off.

    Right now, the Veloster lacks the performance cred to back up its killer looks. But that will change once this 201-hp version hits the streets. The 45 percent boost in horsepower has most folks taking a second look at the Veloster, and hoping this Turbo is a signal that Hyundai is getting as serious about performance as it has been about quality and design over the last few years.

    So far, though, signs remain cloudy—the stonking 1.6-litre motor with dual exhaust notwithstanding. Word is the Veloster Turbo gets the same suspension, which is disappointing. The stock Veloster is fun but stiff-kneed and less refined when compared to better-bred sporty cars like VW's GTI—or the Subaru BRZ, which is only somewhat costlier than what we're expecting to see from the Veloster Turbo. Also, ask Mini engineers about controlling torque steer in a 200-hp car with a short wheelbase. That, too, has probably made Hyundai sweat.

    Walking While Working: Should You Try a Treadmill Desk?


    Sitting is killing you. If the reports are to be believed, all that time you spend working while sitting down will shave precious years off your life expectancy. Medical Billing & Coding issued a gloomy report last year that said "sitting 6 or more hours a day makes you 40 percent likelier to die within 15 years than someone who sits less than 3 hours a day."
    THE GOOD SIDE:
    The TR1200-DT is a solidly made machine consisting of a desktop apparatus that comes separate from the treadmill itself. The desk is simple to put together, but it’s a two-person job to lift the heavy desktop onto the heavy steel legs. The desktop itself is 46.5 inches wide and 31 inches deep, with plenty of room to accommodate your computer, monitor, and pretty much anything you’d need to get your work done. 
     The treadmill itself is comfortable and has a large (20 x 56 inch) walking surface, so you don’t have to worry about falling off while you’re paying attention to your laptop screen. It has just the right amount of bounce and cushion, and the 2.25-hp high torque motor keeps it running for at least 6 hours (and even more in my tests) with no worries about the motor burning out or overheating from constant use. It’s extremely quiet so there’s no threat of distractions during conference calls or Skype sessions.
    THE BAD SIDE:
    The downsides of the Life Span start with the treadmill desk’s massive size. Yes, I listed the huge desktop as a positive above, and it is if space isn’t a premium. But if you’re confined to a small office or workspace, the big treadmill desk is unwieldy. I switched back to my ordinary workstation after this test, but if it weren’t for the swath of space the treadmill desk consumes in my office, I might have become a full convert.

    Another issue with the TR1200-DT in particular is the height-adjustment mechanism. There’s really no practical way to adjust the height of the desk by yourself; it’s a two-person job nearly every time you want to make an adjustment. The weight might make the thing stable and sturdy, but if you want to take the desktop up or down a notch (especially if more than one person will be using the workspace), you’re going to need a partner to help lift the desk while the other pulls out the adjustment knobs.
